Points & Disqualification

Disqualification following the accumulation of twelve points, known as ‘totting up’ is often the most serious scenario that any motorist could face, but disqualification can be avoided.

If you accumulate twelve or more points in a three year period running from the date of the first conviction to the date of the last offence, the court is obliged to disqualify for a minimum period of six months ‘unless the court is satisfied that such a disqualification would cause exceptional hardship’.  If the court finds that exceptional hardship would be caused, it can decide to either disqualify for less than six months or not disqualify at all. The exceptional hardship can be hardship which affects the motorist or some other person or persons.
